## What does a compliant intake call sound like?

Here is a template. Adapt the qualification block to the practice area and leave the rest intact.

> **The story, in their words.** “Tell me what happened, in your own words. I am going to take notes and I may stop you to check a spelling.”
>
> **Qualify.** “A few short questions so I can get you to the right attorney. When did this happen? Has anyone else been involved? Have you spoken with another attorney or signed anything? Is there an insurance company involved, and have they contacted you?”
>
> **Conflict data.** “So we can check for conflicts before your consult, I need the names of everyone involved: the other party, their attorney if you know it, any insurance companies, any businesses, and anyone who referred you. Can we spell each of those?”
>
> **The bright line.** “I am not an attorney, so I cannot tell you whether you have a case or what it might be worth. What I can do right now is book you with one of our attorneys who can answer that.”

> **Book.** “I have Thursday at 2pm or Friday at 10am with Ms Reid. Which works better? I will send a confirmation by text and email with what to bring.”

Three things make the script safe. It states who the caller is speaking to and that the line is recorded. It never answers a legal question. And it ends with a booked time rather than a promise that someone will call back.

Recording is worth a separate note. Federal law and most states allow recording with one party’s consent, but about a dozen require every party to agree. Because inquiries cross state lines, most firms use a single notice at the top of every call. ## How does conflict-check data capture work?

Intake does not run the conflict check. Intake makes sure the check can actually find something. Use this capture list.

**The caller**

- Full legal name, plus former names, maiden names, nicknames and business names
- Date of birth and current address
- Employer and job title where relevant to the matter
- Spouse or partner, and any family members party to the matter

**Everyone else in the matter**

- Adverse parties, individuals and entities, spelled and confirmed
- Opposing counsel and their firm, if known
- Insurance carriers on any side, with claim numbers if the caller has them
- Co-defendants, co-plaintiffs, witnesses and expert names offered
- Related businesses, parent companies and subsidiaries
- The referral source, including whether another firm sent them

**Process**

- Spell every surname back to the caller and mark anything uncertain
- Record names verbatim, never normalized or shortened
- Flag the record as pending conflict clearance so nobody sends an engagement letter early
- Route to the attorney or conflicts clerk the same day
- Log the clearance decision against the record

The most common cause of a missed conflict is not a bad system. It is a half-captured name that the search could never have matched.

Practical notes for either stack. Build one intake form per practice area rather than one long universal form, because a shorter relevant form gets finished. Make conflict fields mandatory so a record cannot advance without them. Set the pipeline so a lead cannot reach the engagement stage until an attorney has marked conflicts cleared. And name the lead source on every record, because that is the only way to know which marketing spend is producing signed matters. ### Can a non-lawyer run intake for a law firm?
